Ecological restoration under EU Courts and ICJ

To support better adjudication of cases involving environmental damage, we are working to identify and analyse the use of the term “restoration” by European courts and international bodies including national courts of EU member States, the European Court of Justice and the International Court of Justice. This research will contribute to the elaboration of a legal definition of “ecological restoration”.

  • ○ A database of over 30 Court decisions related to restoration and analysis of these cases to identify gaps, inconsistencies that could be addressed by a legal definition of “restoration”.

    ○ An article detailing the needs for a legal definition of restoration” and elements to be considered based on a legal assessment and case-law analysis at global level, in the EU and China.

  • L4Earth will further develop the case law database on restoration and make it publicly available. We also will work within a working group in the elaboration of a legal definition for “ecological restoration”.
